WARRANTY
American Energy Services, Inc, hereinafter referred to as AES, warrants its valve(s) to be free of defects in material and/or workmanship for a period of one (1) year from date of shipment. If defects in material and/or workmanship occur during said one (1) year period, AES will, at AES’s option, replace or repair the valve(s) under the following conditions:
1. Valve(s) is/are installed to specified industry standards by qualified/ certified personnel.
2. Valve(s) was/were not used in a service that is not suitable for the valve design.
3. Official AES damaged valve report must be completed and submitted within one (1) year from date of shipment.
4. Any defective valve(s) must be returned to AES for review by AES Quality Assurance Personnel.
5. Seller shall not be responsible for labor, expenses or other damages occasioned by defective valve(s).
6. To the extent consistent with the Uniform Commercial Code, under no circumstances shall Seller be liable for consequential or secondary damages.
7. Warranty is limited to AES valves only. AES is not responsible for any claims against accessories.UNLESS ANY REPAIR OR WORK ON AES VALVE(S) IS AUTHORIZED FIRST, IN WRITING BY AES "AUTHORIZED PERSONELL", APPLICABLE WARRANTY WILL BE NULL AND VOID.
OTHER THAN THE WARRANTY STATED ABOVE, SELLER DISCLAIMS ANY WARRANTY OF MERCHANTABILITY WITH RESPECT TO THE GOODS BEING SOLD. THE WARRANTY ABOVE IS IN LIEU OF ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED. WITH RESPECT TO WARRANTIES, THIS PARAGRAPH STATES BUYER’S EXCLUSIVE REMEDY AND SELLER’S EXCLUSIVE LIABILITY.
